    TECHNICAL REGULATION OF CUSTOMS UNION (TRCU)

    The Federal Law on Technical Regulation No. 184-FZ dd. introduces the definition “Technical Regulations” on December 27, 2002. The law separates a concept of technical regulation and standard and establishes the approach for application of standards. Unlike the standards, the technical regulations are mandatory and establishes the minimum requirements for safety and healthy insurance for different kind of products. The Technical Regulations could be compared with the EU Directive for Machinery.

    Republic of Belarus, Republic of Kazakhstan and Russian Federation have commenced in June 2010 the establishment of the unified technical regulation system. Government agencies of three countries delegate relevant authorities on adoption of technical regulations to the Customs Union Commission. At the same time this Commission coordinates efforts of three countries applicable to technical regulation. The national norms will be terminated after the technical regulations of the Customs Union become effective. The technical regulations have a direct effect on the territory of three countries.

    The certification process for this regulation is EAC (Euroasian conformity) certification. 47 regulations have been included to the schedule of development of priority regulations of the Customs Union. In particular they are:

    EAC CONFORMITY AND EXPORT OF GOODS, DECLARED ACCORDING TO TR CU

    The Technical Regulations declare the products, which require the mandatory confirmation in form of declaration or certification. The certificates about the conformance to the technical Regulations are valid on the entire territory of the Customs Union (Russia, Belarus and Kazakhstan). During the period of transformation the documents issued according to the old regulations and norms are valid until 2015.

    The certification of conformance are required for new products, machines and equipment only. The used products, machines and equipment does not require the certification. Instead of the certification you will need to apply for confirmation of the remaining utility value. We provide you with necessary information how to obtain this document, if necessary.

    The certification of conformance will be completed in form of declaration and certification. In both cases the manufacturer will be required to provide the product documents such as technical documentation, safety instructions, manuals and others, which will be proved on compliance to the minimum requirements to the regulation and its norms. After successful certification the manufacturer is allowed to mark the product with the EAC mark.

    The TR CU certificate of TR CU declaration of conformance are the part of the export documents and needs to be provided at the boarder of entrance on the territory of the Customs Union.

    SPECIAL REQUIREMENTS AND SPECIFICS OF CERTIFICATION AND DECLARATION ACCORDING TO TR CU

    1. The company registered on territory of Customs union only (manufacturer itself or its authorized representative) can apply for certification and declaration: The simple power of attorney is not enough for authorized representative to become the authorization. The manufacturer shall close a contract with authorized representative about the transfer of the responsibility for the product quality and assurance of the warranty for the local customers. We will provide the template of the contract on request.

    Please also note that for one-delivery-only the role of the applicant can be agreed with the local customer.

    2. For certification of the serial production beyond of the conformity test the factory inspection and the yearly factory inspection for the entire duration of validity of certificates will be required to fulfill the certification process and to ensure the quality of the manufacture. For declaration the responsibility to ensure the quality of the manufacture could be transferred to the manufacturer or its authorized representative.

    Execution time: 3-5 days after a complete package of documents is provided and, if required, the factory inspection is completed.
    Validity period: For one-time-delivery or maximum 5 years.
